Welcome to Bookitsy ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our booking and scheduling platform, website, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and Bookitsy s.r.o., a company registered in the Czech Republic.

Bookitsy provides a comprehensive booking and scheduling platform that enables businesses to:

• Manage appointments and bookings online
• Process payments and handle billing
• Communicate with customers
• Access analytics and reporting tools
• Integrate with third-party services

Our Service is designed for service-based businesses including but not limited to salons, spas, fitness studios, healthcare providers, and professional services.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to users.

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems

We reserve the right to investigate violations and take appropriate action, including account suspension or termination.

We strive to maintain high service availability but cannot guarantee uninterrupted access. Our Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical difficulties or system failures
• Third-party service interruptions
• Force majeure events

We reserve the right to modify, update, or enhance the Service at any time. We will provide reasonable notice of significant changes that may affect your use of the Service.

Service level agreements (SLAs) and uptime commitments are specified in your subscription plan and may vary by plan tier.

Our Service operates on a subscription basis with the following payment terms:

• Billing Cycles: Monthly or annual, as selected during subscription
• Payment Methods: Credit card, debit card, or other approved methods
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Price Changes: We will provide 30 days notice of price increases
• Taxes: Prices are exclusive of applicable taxes unless stated otherwise

Transaction processing fees may apply to payments processed through our platform. These fees are disclosed during the payment setup process.

Refunds are handled according to our refund policy. Generally, no refunds are provided for partial months of service.

Failure to pay may result in service suspension or termination after appropriate notice.

Your privacy and data security are important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key data protection principles:

• We process personal data in accordance with GDPR and applicable privacy laws
• Customer data remains owned by the customer
• We implement appropriate technical and organizational security measures
• Data processing agreements are available for enterprise customers

The Service and its original content, features, and functionality are owned by Bookitsy and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes in accordance with these Terms.

You retain ownership of content you upload to the Service ("User Content"), but grant us a license to use, store, and process such content to provide the Service.

You may not:

• Copy, modify, or distribute our proprietary content
• Reverse engineer or attempt to extract source code
• Remove or alter proprietary notices
• Use our trademarks without permission

You are solely responsible for all content you upload, post, or transmit through the Service ("User Content"). You represent and warrant that:

• You own or have necessary rights to all User Content
• User Content does not violate any third-party rights
• User Content complies with applicable laws and these Terms
• User Content does not contain harmful or malicious code

We reserve the right to remove User Content that violates these Terms or applicable laws. We are not responsible for User Content and do not endorse any opinions expressed therein.

You agree to backup your data regularly. While we implement backup procedures, you remain responsible for maintaining copies of your important data.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKITSY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Service interruptions or downtime
• Third-party actions or content
• Security breaches beyond our reasonable control
• Errors or omissions in the Service

Our total liability for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Bookitsy, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights
• Your violation of applicable laws

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you.

Either party may terminate this agreement at any time:

• By You: Cancel your subscription through your account settings or by contacting support
• By Us: For violation of Terms, non-payment, or other reasonable cause with appropriate notice

Upon termination:

• Your access to the Service will be suspended
• You may export your data for a limited time (typically 30 days)
• We may delete your data after the retention period
• Outstanding payments remain due

Provisions that by their nature should survive termination will remain in effect, including intellectual property rights, limitation of liability, and indemnification.

We prefer to resolve disputes amicably. If you have a concern, please contact us first at legal@bookitsy.com.

For unresolved disputes:

• Both parties agree to first attempt mediation
• If mediation fails, disputes will be resolved through binding arbitration
• Arbitration will be conducted under the rules of the Czech Arbitration Court
• The arbitration location will be Prague, Czech Republic
• Each party bears their own costs unless otherwise determined by the arbitrator

This clause does not prevent either party from seeking injunctive relief in court for intellectual property violations or urgent matters.

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles.

Any legal proceedings not subject to arbitration will be conducted in the courts of Prague, Czech Republic.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

These Terms constitute the entire agreement between you and Bookitsy regarding the Service and supersede all prior agreements and understandings.
